Important Updates for Onsite Wastewater Practitioners...

ROWP Commercial General Liability Insurance Update B007.06
It has come to the attention of ASTTBC that many of our ROWPs, involved in the 'construct and design' of septic systems, are still having difficulty in obtaining the Commercial General Liability Insurance. The difficulty for the insurer is that many of our ROWPs are involved in activities that cannot be classified as Onsite Wastewater work. The insurance is designed to only accommodate that work which requires certification and registration as a ROWP.

To get around this dilemma it may be necessary, for our ROWPs affected by the nature of their work activities, to create a completely separate legal entity or corporation under which all the Onsite Wastewater activities are conducted and invoiced. The ASTTBC insurance broker, Willis Canada Inc., is handling applications for insurance on a case-by-case basis and is prepared to discuss these issues as they arise with each individual ROWP application.

ROWP Insurance Program B003.05 | September 15, 2005
ASTTBC is pleased to present the following information, as supplied by our insurance brokers Willis Canada Inc., for the provision of both Errors & Omissions Insurance (E&O) and Commercial General Liability Insurance (CGL) to Registered Onsite Wastewater Practitioners.

The program for ROWPs is divided between the following categories...

A. Installation (including the design of the system) and/or Maintenance Services. For the ROWP that falls into this category, please complete application form titled 'Application Form 1 - ING Insurance Company of Canada'... click here to download application form as a WORD document (134kb)

B. Design and/or Inspection Services only. ROWPs under this category do not provide any installation or maintenance services. For the ROWP that falls into this category, please complete application form titled 'Application Form 2 - Design and Inspection Services'... click here to download application form as a WORD document (98kb)

To facilitate the process, please include with your application form:

  • Corporate entity name where applicable;
  • Details on all operations and revenue generated from each type of operation carried out by ROWP including those not falling under the auspicious of the Onsite Wastewater program;
  • Include a copy of ROWP practising certificate or other evidence of designation;
  • Details of any claims suffered by you or your company in the preceding 5 years;
  • If property insurance is required, please provide details of equipment, buildings and other property for which insurance is required.

Please note that though the necessary coverages have been agreed with insurers, pricing can only be provided after the insurers have reviewed all the information requested.

While some details on individual applicants need to be defined, it is our understanding at ASTTBC that the CGL will cover ROWPs who are doing both the site assessment/design and installation, including maintenance. We further understand that the limit on the CGL insurance is $2 million, with a $1,000 deductible (BI/PD).

Other conditions should be discussed with Willis Canada Inc., but warranty issues such as installed faulty equipment are the responsibility of the ROWP. The insurance premium cost, depending on individual circumstances, is expected to be in the region of $1,650.

For registrants providing only planning and inspection services, the previously established E&O insurance for ROWPs is still available and is all that is required to cover those services. The cost for E&O insurance is in the same range as with the CGL insurance.

For those registrants who may do planning and installation, but occasionally only do the planning or inspection of a system under separate contract, may be required to carry both E&O and CGL insurance.
